Terms of Service

These Terms of Service (“Terms”) govern your use of WHD Reach and the websites at whdfoundation.org and app.whdfoundation.org (the “Service”), operated by the William H. Douglas Foundation (“WHD,” “we,” “us”), a California 501(c)(3) nonprofit. By using the Service you agree to these Terms.
The Service
WHD Reach lets supporters join, give, and manage recurring memberships, sponsorships, coaching, and one-time donations, and provides college-access advising and program tools for students and families.
Accounts and eligibility
- Public supporter/donor accounts are for adults (18+). You are responsible for keeping your login secure and for activity under your account.
- Students who are minors may use the Service only through our parent/guardian-consent process. See our Privacy Policy.
- Provide accurate information and keep it up to date.
Agreement before you submit or pay
Before submitting any application or form, and before making any payment to WHD, you must tick the box confirming you have read and agree to these Terms and our Privacy Policy. That confirmation is required, is recorded with the date and the version of these Terms shown to you, and applies to Fellows and internship applications, board applications, memberships, sponsorships, Legacy Partner packages, and donations.
No refunds
All payments to the Foundation are final and non-refundable. This includes, without limitation:
- Board dues and annual board contributions;
- Membership dues and recurring membership payments;
- Sponsorships and Legacy Partner packages;
- Coaching and program fees;
- One-time and recurring donations.
Payment does not entitle you to a seat, a role, a vote, an award, or any particular outcome. Board seats and program placements are limited and are granted only on review by the Foundation. If your application is declined, waitlisted, or withdrawn, or if no place is available, your payment is not returned and is treated as a charitable contribution to the Foundation.
You may cancel a recurring membership at any time from your account. Cancellation stops future charges; it does not refund amounts already paid.
If you believe a charge was made in error, or was duplicated, contact us at giving@whdfoundation.org and we will investigate. Correcting a genuine processing error is not a refund and does not change the policy above.
Membership and participation in the Foundation
Becoming a member, director, Fellow, sponsor, or Legacy Partner of WHD means you agree to:
- Provide accurate, complete information in your application and keep it current.
- Act in the Foundation’s interest and in keeping with its mission of college access for students regardless of socioeconomic background.
- Keep confidential any student, family, personnel, or board information you encounter, and never use it for any purpose other than your role.
- Comply with the Foundation’s policies on student privacy and child safety, including FERPA-aligned handling of student records and any background check required for a role involving minors.
- Disclose conflicts of interest as they arise and recuse yourself where required.
Membership, board seats, and volunteer or Fellow roles are granted at the Foundation’s discretion, are not employment, and may be declined, not renewed, or ended by the Foundation at any time. Directors serve subject to the Foundation’s bylaws, which govern in the event of any conflict with these Terms.
Donations, memberships, and payments
- Donations and sponsorships are voluntary gifts to a 501(c)(3) and are generally tax-deductible to the extent allowed by law; we provide a receipt. The deductible amount may be reduced by the value of any goods or services you receive.
- Recurring memberships and coaching plans bill on the interval shown at checkout until you cancel.
- Payments are processed by a third-party, provider-hosted checkout. We do not store card details.
Acceptable use
You agree not to:
- Use the Service unlawfully or to harm others.
- Attempt to access accounts or data that aren’t yours.
- Disrupt, probe, or reverse-engineer the Service.
- Upload malicious code or misleading information.
Intellectual property
The Service, including its content and branding, belongs to WHD or its licensors. We grant you a limited, revocable, non-transferable right to use the Service for its intended purpose.
Third-party services
The Service integrates with third parties (for example, payment processing and QuickBooks Online accounting). Your use of those services is also subject to their terms and privacy policies.
Disclaimers and limitation of liability
The Service is provided “as is” without warranties of any kind. To the fullest extent permitted by law, WHD is not liable for indirect, incidental, or consequential damages arising from your use of the Service. Nothing here limits liability that cannot be limited by law.
Termination
You may stop using the Service at any time. We may suspend or terminate access if these Terms are violated or to protect the Service and our community.
Governing law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules.
Changes
We may update these Terms from time to time. Continued use after changes means you accept the updated Terms.
